{"id":16877,"date":"2021-06-22T18:36:50","date_gmt":"2021-06-22T18:36:50","guid":{"rendered":"https:\/\/vaabc.com\/blog\/?p=16877"},"modified":"2022-08-25T02:35:33","modified_gmt":"2022-08-25T02:35:33","slug":"skill-gaming-lawsuit","status":"publish","type":"post","link":"https:\/\/vaabc.com\/blog\/skill-gaming-lawsuit\/","title":{"rendered":"Skill Gaming Lawsuit"},"content":{"rendered":"\n<p><a href=\"https:\/\/collicts-unityprus.com\/9c751d2c-2bea-4940-b92f-49c1e37ac4e5?campaign_id=0024aa57d7814599ab049461d2937291c5&amp;ad_id=0013e34003231925873252b6acce54d335&amp;ob_click_id=$ob_click_id$&amp;section_name=$section_name$&amp;section_id=$section_id$&amp;obOrigUrl=true\" target=\"_blank\" rel=\"noreferrer noopener\"><\/a><\/p>\n\n\n\n<h2><a href=\"https:\/\/searchtopics.net\/index.php?rgid=120944&amp;gclid=$ob_click_id$&amp;obOrigUrl=true\" target=\"_blank\" rel=\"noreferrer noopener\"><\/a>Former NASCAR driver files lawsuit against Virginia\u2019s slated skill games ban!<\/h2>\n\n\n\n<p>By&nbsp;<a href=\"https:\/\/www.nbc12.com\/authors\/hannah-eason\/\">Hannah Eason<\/a>&nbsp;and&nbsp;<a href=\"https:\/\/www.nbc12.com\/authors\/brent-solomon\/\">Brent Solomon<\/a><em> <\/em><\/p>\n\n\n\n<p>A former NASCAR driver and Virginia business owner has filed a lawsuit against the commonwealth in hopes that the Virginia Circuit Court will rule a ban against skill games as unconstitutional.<\/p>\n\n\n\n<figure class=\"wp-block-embed is-type-video is-provider-youtube wp-block-embed-youtube wp-embed-aspect-16-9 wp-has-aspect-ratio\"><div class=\"wp-block-embed__wrapper\">\n<iframe title=\"Former NASCAR driver files lawsuit against Virginia for upcoming skill games ban\" width=\"1200\" height=\"675\" src=\"https:\/\/www.youtube.com\/embed\/hBORJ3xEGtw?feature=oembed\" frameborder=\"0\" allow=\"accelerometer; autoplay; clipboard-write; encrypted-media; gyroscope; picture-in-picture\" allowfullscreen><\/iframe>\n<\/div><\/figure>\n\n\n\n<p>Hermie Sadler, a former NASCAR driver from Emporia, Virginia, filed a suit against the Commonwealth of Virginia, Governor Ralph Northam, Attorney General Mark Herring and the Virginia ABC, according to a release from Sadler\u2019s attorney. The suit was filed in Greensville County.<\/p>\n\n\n\n<p><a href=\"https:\/\/lis.virginia.gov\/cgi-bin\/legp604.exe?201+sum+SB971\" target=\"_blank\" rel=\"noreferrer noopener\">Senate Bill 971<\/a>, which would ban skill games at any businesses other than family entertainment centers, is set to go into effect on July 1. According to the release, the suit argues the bill is unconstitutional and therefore unenforceable. It also states the bill will adversely affect small businesses such as convenience stores, truck stops, restaurants and bars.<\/p>\n\n\n\n<p>Sadler states the exception for family entertainment centers would restrict him from offering the games at his truck stop and other businesses. He argues, this creates an \u201cimpermissible\u201d content-based restriction on the video games allowed in the state. The suit states the legislation will discriminate against retail locations that do not market to families with children.<\/p>\n\n\n\n<p>The suit argues the ban would be unconstitutionally vague and overbroad, violating due process or fair treatment under the law.<\/p>\n\n\n\n<p>Over at Styles Bi-Rite Convenience Store in Chesterfield, people come in every day to play electronic skill games, including Bradley Hammond.<\/p>\n\n\n\n<blockquote class=\"wp-block-quote\"><p>\u201cJust about every day&#8230; it\u2019s enjoyable. Sure it is. Anyone who wins any kind of money says it\u2019s fun,\u201d he said.<\/p><\/blockquote>\n\n\n\n<p>It\u2019s why he and others are disappointed to see the machines shut down in just a matter of days.<\/p>\n\n\n\n<blockquote class=\"wp-block-quote\"><p>\u201cI worked with the legislature on the games of skill. They made it quite clear that after this year, they wanted those to stop in Virginia. I was part of that agreement. I kept my word and the legislature, that is still their intention. There are some like Senator Stanley that want to move on with that, but that\u2019s up to the legislature,\u201d Northam said Monday.<\/p><\/blockquote>\n\n\n\n<p>In the lawsuit, Sadler claims banning the machines would be unconstitutional, hurting not just convenience stores but also truck stops and bars.<\/p>\n\n\n\n<blockquote class=\"wp-block-quote\"><p>\u201cThe amount of money that we make off of the machines is very beneficial for our locally owned business&#8230; they just make too much money to get rid of them,\u201d Stephanie Brazier of Styles Bi-Rite said.<\/p><\/blockquote>\n\n\n\n<blockquote class=\"wp-block-quote\"><p>\u201cOne thing about it, I guess we\u2019ll get a raise because we won\u2019t be spending any kind of money,\u201d Hammond added, jokingly.<\/p><\/blockquote>\n\n\n\n<blockquote class=\"wp-block-quote\"><p>\u201cWhether you are for or against the legalization of gambling in Virginia, both the legislature and executive branch have spoken, legalizing the multi-billion dollar industries of sports betting, horse racing, slot machines and casino gambling,\u201d Sadler said, Monday in a press release. \u201cBut inexplicably, Virginia has determined that skill games, games that have been legal in the Commonwealth for decades, are now somehow \u2018undesirable,\u2019 and should be made illegal. This action is unfair, and quite frankly, unconstitutional.\u201d<\/p><\/blockquote>\n\n\n\n<p>Legislators agreed to ban the games during last year\u2019s General Assembly session, but the governor\u2019s administration proposed taxing them for one year to generate money for COVID-19 relief. After language in a 2021 bill&nbsp;<a href=\"https:\/\/www.nbc12.com\/2021\/03\/16\/did-virginia-lawmakers-accidentally-vote-legalize-skill-games-another-year\/\" target=\"_blank\" rel=\"noreferrer noopener\">drew confusion<\/a>, presumably extending skilled gaming until 2022,&nbsp;<a href=\"https:\/\/www.nbc12.com\/2021\/03\/21\/northam-amends-gambling-bill-reiterate-ban-skill-machines\/\" target=\"_blank\" rel=\"noreferrer noopener\">Northam amended the bill&nbsp;<\/a>to reiterate the prohibition slated for July 1.<\/p>\n\n\n\n<blockquote class=\"wp-block-quote\"><p>\u201cSmall businesses, including convenience stores, truck stops and restaurants\/bars, have depended on the revenues generated from these games to survive during the government shut-down of Virginia by Governor Northam as a result of the COVID-19 pandemic,\u201d Sadler said. \u201cWhile a truck stop or a convenience store may not be as fancy as a Hard Rock or Bally\u2019s Casino, they should not be excluded from this marketplace.\u201d<\/p><\/blockquote>\n\n\n\n<p>The bill defines a \u201cskill game\u201d as an electronic or computerized machine that requires a form of currency to play or activate a game. The outcome is determined by an element of skill from the player to receive cash, cash equivalents or anything of value.
