{"id":9919,"date":"2019-08-02T18:10:26","date_gmt":"2019-08-02T18:10:26","guid":{"rendered":"http:\/\/vaabc.com\/blog\/?p=9919"},"modified":"2022-09-23T19:47:54","modified_gmt":"2022-09-23T19:47:54","slug":"the-abcs-of-gambling","status":"publish","type":"post","link":"https:\/\/vaabc.com\/blog\/the-abcs-of-gambling\/","title":{"rendered":"The ABC&#8217;s of Gambling"},"content":{"rendered":"\n<p>Many of Virginia ABC\u2019s clients are following the stories regarding gambling\nvs. gaming, specifically because of an electronic game: \u201cQueen of Virginia.\u201d\nThis game has been a point of contention because the game (created by Pace-O-Matic\nCompany) requires a level of skill, not just chance \u2013 therefore, Virginia\nDepart. of Alcoholic Beverage Control Authority issued their opinion: the game\ndid not meet the Virginia\u2019s definition of gambling and is, in fact, a game of\nskill. <\/p>\n\n\n\n<figure class=\"wp-block-image\"><img fetchpriority=\"high\" decoding=\"async\" width=\"1024\" height=\"675\" src=\"https:\/\/vaabc.com\/blog\/wp-content\/uploads\/2019\/03\/queen-of-Virginia-skill-game-1024x675.jpg\" alt=\"Queen of Virginia Skill Game - Gambling (ABC Consulting)\" class=\"wp-image-9920\" srcset=\"https:\/\/vaabc.com\/blog\/wp-content\/uploads\/2019\/03\/queen-of-Virginia-skill-game-1024x675.jpg 1024w, https:\/\/vaabc.com\/blog\/wp-content\/uploads\/2019\/03\/queen-of-Virginia-skill-game-300x198.jpg 300w, https:\/\/vaabc.com\/blog\/wp-content\/uploads\/2019\/03\/queen-of-Virginia-skill-game-768x506.jpg 768w, https:\/\/vaabc.com\/blog\/wp-content\/uploads\/2019\/03\/queen-of-Virginia-skill-game-600x396.jpg 600w, https:\/\/vaabc.com\/blog\/wp-content\/uploads\/2019\/03\/queen-of-Virginia-skill-game.jpg 1200w\" sizes=\"(max-width: 1024px) 100vw, 1024px\" \/><\/figure>\n\n\n\n<p>This is from <a href=\"https:\/\/www.vaskillgames.com\/\">Pace-O-Matic Company<\/a>\n(the manufacturer): <\/p>\n\n\n\n<ul><li>QVS has been certified by a Virginia Recognized Testing Lab.<\/li><li>The Queen of Virginia Skill &amp; Entertainment game terminals use Pace-o-Matic\u00ae skill game software.<\/li><li>QVS is the only game in Virginia using Pace-o-Matic\u00ae software.<\/li><li>No Internet Connection is needed.<\/li><li>Players can WIN every time&#8211;based on skill &amp; not chance.<\/li><li>The software which QVS utilizes has been adjudicated in a court of law, as a skill predominate game.<\/li><li>A typical profit margin: five percent is taken off the top and goes back to the community. The other 95 percent is divided between the owner\/operator and the manufacturer (30 percent). <\/li><\/ul>\n\n\n\n<p>One <a href=\"https:\/\/pilotonline.com\/business\/consumer\/article_c0852932-749b-11e8-bdc6-c7c126d4ae95.html\">interview<\/a> with patron Roger Houston, at Mike\u2019s Break Room, said\nthat each game selected requires a \u201cskill,\u201d (hand-eye coordination or\nmemory) and if he wins, he gets back 104 percent of what he put in (between\n$0.40 and $4.00). Playing \u201cQueen of Virginia,\u201d is not gambling, he says.&nbsp; One game that Roger Houston was playing is\ncalled \u201cFollow Me,\u201d and is a memory game. Rows of circles appear on the screen.\nThey light up one by one, and then Roger has to mimic that pattern. <strong>Skill<\/strong>! Not chance. <\/p>\n\n\n\n<p>Virginia has three catchall factors that form the standards of what is\ndefined as gambling. Chance, Prize and Consideration and if one of those\nelements is missing, the activity isn\u2019t an illegal activity: \n \n \n  \n  \n  \n  \n  \n  \n  \n  \n  \n  \n  \n  \n \n \n \n\n \n \n<\/p>\n\n\n\n<ul><li>An individual must place a bet or wager\n(Consideration)<\/li><li>There must be an opportunity to win a prize\n(Prize)<\/li><li>Chance must be a predominant factor (Chance, NOT\nskill)<\/li><\/ul>\n\n\n\n<p>This game was categorized by the VA Office of Attorney General as a game of\nskill as opposed to a game of chance, thus making it a legal game for VA\nAlcohol businesses to put in their licensed locations. Furthermore, the VA ABC\npledged to not initiate administrative charges against any licensee that uses\nthe machines on their premises in light of this decision. \n \n \n<\/p>\n\n\n\n<p>Although many businesses have added \u201cQueen of Virginia\u201d to their alcohol\nbusinesses, the VA. Virginia Dept. of Alcoholic Beverage Control Authority isn\u2019t\nissuing any more &#8220;letters of approval.&#8221; There is a lot of confusion among\nlicensees and the agents \u2013 as well as the general public. Ask agents in\ndifferent parts of the state and you\u2019ll likely get two different answers. Why?\nBecause it is as clear as mud!&nbsp; The\nbottom line? The Virginia Depart. of Alcoholic Beverage Control Authority is not\nbringing administrative charges against businesses with skilled gaming machines.\nAny locality can conduct their own investigation and create their own opinion\nresulting in a machine being deemed a gambling machine. If such locality deems\nthe machine to be gambling, then VA ABC will file charges against the licensee.&nbsp; So, what <strong>should<\/strong>\nyour business do, regarding this gaming machine? Reach out to an ABC\nConsultant, an attorney, a local commonwealth attorney, or their assigned ABC\nSpecial Agent.
