Does my Name have to be on the ABC License?
In Virginia, most businesses operate under a legal entity known as an LLC or INC, therefore, the owners are considered members if they operate as an LLC and officers/directors if they operate as a corporation. The VA ABC license is issued to the legal entity name. Any members, officers, directors, shareholders who own 10% or more must be disclosed on the VA ABC retail application. Any person holding a title such as President, VP, Secretary, or Treasurer despite their ownership percentage must be disclosed on the VA ABC retail application.
Once an ABC license is issued, members, officers, directors, and or shareholders who change their ownership percentage or title must disclose such change to the Virginia Dept. of ABC Authority within 30 days of such a change to avoid ABC civil penalties.
