What Changed

Oversight moved to the ABC Authority

Virginia has enacted a new law — House Bill 308 (identical to Senate Bill 620), now Chapter 1044 of the 2026 Acts of Assembly — that overhauls how retail tobacco and liquid nicotine are regulated. Responsibility for licensing and enforcement is moving from the Department of Taxation to the Virginia Alcoholic Beverage Control Authority.

The law creates a new permitting system under Title 4.1 of the Code of Virginia. In practice, that means a retailer who sells tobacco products will need a state-issued permit, much like the way alcohol sales already work in the Commonwealth.

Who needs a permit

Most stores that sell tobacco or vapor products will need to hold an annual permit for each location. That includes:

  • Convenience stores, gas stations, and grocers selling cigarettes
  • Vape and smoke shops selling e-cigarettes, e-liquids, and disposable vapes
  • Any retailer selling liquid nicotine or nicotine vapor products
  • Exempt: Stores that sell only cigars or pipe tobacco.

One permit covers vapor products

Virginia does not require a separate vape license. The ABC retail tobacco permit covers vapor products as well, including e-cigarettes, e-liquids, and disposable vapes.

The Deadline that Matters

October 1, 2026

The permitting provisions take effect October 1, 2026. To avoid any interruption in sales, retailers should have an application on file with the ABC Authority before that date. A business that waits until after the system goes live risks having to stop selling until its permit is approved.

The exact transition rule — whether a pending application lets you keep selling during review, or whether you need an approved permit in hand — will be set by ABC's implementing guidance, which has not yet been published. We are tracking it and will update this page, and the application form below, the moment the official process is released.

Enforcement and obligations

  • Underage compliance checks. ABC will run unannounced underage-buyer operations at least once every 24 months at each permitted location, with extra checks after a violation.
  • Recordkeeping and inspections. Permit holders must keep sales records and allow their establishments to be inspected.
  • Permits can be refused, suspended, or revoked for age-restriction violations, misrepresentation, and related offenses.
  • Penalties. Selling without a permit, refusing inspection, or selling to anyone under 21 carries fines. Enforcement is shared with the Office of the Attorney General.

Separate but related: the vape product directory

Since April 1, 2026, all liquid nicotine and nicotine vapor products sold in Virginia must appear on the state's official product directory. This is a distinct requirement from the permit, but it affects the same retailers — if you sell vapor products, both apply to you.
