Can you imagine going to your favorite nail salon to get a mani or pedi and being served a glass of beer or champagne? You enjoy that alcohol and the service, very much. You get ready to leave and you pay for the service, not really think anything more about it…until the next time you come. That nail tech got fired for serving alcohol.

You cannot serve alcohol without a license – and the Day Spa license is the only license in the state of Virginia that allows you to serve alcohol.

  • The patron has to purchase a service
  • The alcohol has to be part of the service
  • The day spa has to be licensed.

In Virginia you cannot provide alcohol or sell alcohol without having the proper alcohol license. The Day Spa Alcohol License allows the certified cosmetologist or the certified massage therapist to provide alcohol, during a service. You MUST have BOTH services available and BOTH therapists available, in order to provide alcohol. In other words, the license allows the Day Spa (that offers both of those services) to provide alcohol beverage DURING the service.

Your client comes in for a nail service (and both a certified massage therapist and certified nail technician are in the building) and you offer them a glass of alcohol.

What happens if you have a high-end jewelry store and you want to serve alcohol? You cannot. The enforcement of Virginia ABC Authority sees that as “drinking in public,” which is against the law. Your patron could be arrested. And if you are selling a service or selling a product and serving alcohol, you are serving alcohol without a license, therefore, you can be charged with a Class 1 Misdemeanor.
