What does Governor Northam say about ToGo alcohol?

During the past 15 months, Virginia Governor Ralph Northam has issued an Executive Order (Fifty One (51)). This executive order has undergone countless changes and it is, perhaps, difficult to keep up. This article will try to answer the question of ToGo and Delivery, for businesses that currently have an on-premises alcohol permit.

QUESTION: Can you deliver cases of wine or beer? ANSWER: You must have a Distillery License with approved tasting rooms or a Mixed Beverage Restaurant License.

  • Sales are only authorized to individuals who are otherwise legally qualified to purchase wine and beer.
  • No more than four cases of wine (nor more than four cases of beer) may be delivered at one time to any person in Virginia to whom alcoholic beverages may be lawfully sold.
  • Signature waived, during COVID executive order, as long as customer’s name is attached to outside of order, in 16-point font and proof of age has been verified, in another way. This notice will be posted in a conspicuous location, stating: “CONTAINS ALCOHOLIC BEVERAGES; SIGNATURE OF PERSON AGED 21 YEARS OR OLDER REQUIRED FOR DELIVERY.” Such notice shall also contain the delivery permit or license number of the delivering permittee.

QUESTION: Can you deliver Mixed Beverages (Cocktails)? ANSWER: You must have a Distillery License with approved tasting rooms or a Mixed Beverage Restaurant License.

  • Distillery Licensees: Each drink must contain 1.5 oz or less of spirits and are limited to a maximum of TWO mixed drinks per delivery or takeout order to a maximum of 4 mixed drinks, per order.
  • Mixed Beverage Restaurant Licensees: Each delivery or takeout order must include ONE meal per TWO mixed drinks purchased. *no more than FOUR mixed drinks per delivery or takeout order.
  • Packaging Requirements: Mixed drinks must be packaged in a container made of glass, paper, plastic, or in a single original metal can with a secure lid or cap. Lids with sipping holes or openings for straws are prohibited.
  • Volume Requirements: “Cocktail” shall be defined as a single, alcoholic drink consisting of one or more spirits, wine or beer and at least one mixer with a maximum combined value, not to exceed 16 ounces.
  • Transportation Requirements: Mixed drinks must be stored in the trunk of the vehicle. if no trunk, then in an area that is not accessible by the driver.
  • Time Restrictions: Mixed beverage sales permitted between 6am – 11pm only.
  • Recipient Requirements: Recipients must be at least 21 years of age to receive delivery or takeout orders.
