New Alcohol License, in Virginia

Virginia has another alcohol license that might make your entrepreneurial wheels spin. It did ours. Just think: dark chocolate, decedent dessert candy, alcohol – all tied up in a confection. Introducing: the Confectionery License, in Virginia.

Liqueur-filled candies are gaining popularity – the alcohol serves as filling and it is not cooked off – and it does require an alcohol license to sell them. Our government guidelines require that these candies carry a warning label denoting their alcohol content and any business creating and selling these candies has to have the proper licensing.  ABC Consulting will give you the skinny!

3VAC5-50-250 Confectionery Alcohol License – a confectionery means a general class of sweet foods and edibles (including baked goods and candies) having an alcohol content not more than 5.0% by volume. The alcohol cannot be in a liquid form, in such confectionery; at the time it is sold (it should be fully integrated/blended into the confectionery product). These confectioneries should only be sold to those individuals that can lawfully consume alcohol. If your establishment is licensed (apply here) to sell confectionaries for off-premises consumption, make sure to properly label the product:

  • Note the product contains alcohol
  • Note that the product can only be consumed off premises
  • Note the warning that the product should only be consumed by those over the age of 21.

This confectionary license, which shall authorize the licensee to prepare and sell on the licenses premises for off-premises consumption, has a confectionery that contains 5% or less alcohol, by volume. Any alcohol contained in such confectionery shall not be in liquid form at the time such confectionery is sold.
